Reg: Illegal and mass charge sheets being given to employees and officers
Our attention has been drawn to the instructions given by Central Office to issue charge sheets/show cause letters to nearly 7000 employees and officers all over the country for participating in the All India Strike on 22-1-2007.
In this connection we wish to bring to the attention of the management
I. That the management is fully aware through the notice for the strike served by our United Forum dated 2-1-2007 that all the members of the Unions constituted by the United Forum of Central Bank Unions viz. AICBEF, AICBOF, AICBEC, AICBIOA, RCBOC, CBAEFI, AICBSF and AICBWO would be participating in the strike on 22-1-2007.
II. That there is no need for any individual notice to be given by the employees and officers who are members of the above Unions.
III. That notwithstanding this legal position, the management issued instructions to all the 40,000 employees and officers to submit individual letters to the management as to their participation in the strike on 22-1-2007. That this was a totally illegal and amounted to unfair labour practice
IV. That this was a deliberate attempt on the part of the management to threaten and intimidate the employees and officers which is again a clear case of unfair labour practice
V. That the management issued number of communication and circulars to the staff in a direct attempt to incite and instigate the staff to defy and boycott the call of the trade unions for the strike on 22-1-2007.
VI. That the management conducted number of staff meetings all over the country, during office hours at the cost of closing down the business hours, at the cost of customer services in the branches , etc. and in all these meetings, the staff were attempted to be mislead with a false propaganda that the agitation is a personal fight and war between the Union leaders and the CMD, thus deliberately trying to divert the issues on which the Unions are agitating which again amount to unfair labour practice.
VII. That notwithstanding all these threats, intimidations, propaganda, coercions, etc. all the employees and officers have magnificently responded to the call of the Unions and joined the strike action enmasse.
VIII. That this wholesome participation of the entire staff in the strike action on 22-1-2007 has only confirmed that the employees and officers do have genuine grievances and the unions have raised these issues in the agitation.
IX. That while in the pre-strike propaganda, the top management repeatedly propagated that it is a war and personal fight between the union leaders and the management and employees are not part of this, the true colour of the management has now come out by the instructions of your office to issue charge sheet to nearly 7000 employees and officers for the mere participation in the strike and threatening them with serious punishments.
X. That the concerned employees and officers are being charged with misconduct for not having gone one strike action with the keys is untenable on the ground that the management was fully aware through our Notice dated 2-1-2007 that all our members would participate in the strike. The management did not make any alternative arrangements to receive the keys from them. Hence, the management’s action is high-handed, vindictive, illegal, unfair and unwarranted besides being highly provocative.
XI. That there has been absolutely no individual misconduct whatsoever on the part of these employees and officers and they have only obeyed their call of their trade union in pursuit of collective bargaining which is a legitimate right of the staff.
XII. That in view of the above, the management’s vindictive and illegal action needs immediate withdrawal forthwith.
We strongly protest these vindictive actions of the management and demand that the management should retrace their steps and send revised instructions to withdraw the charge sheets failing which, our United Forum would be required to take and initiate all necessary steps legally and organizationally.
